Cómo se gravan las ganancias de trading en Colombia

Forex/CFD profits from international brokers must be declared to DIAN in the annual income-tax return. Gains from short-term trading (assets held under 2 years) are taxed as ordinary income on the progressive scale 0% up to 39% (UVT brackets; UVT 2024 = COP 47,065). Gains on assets held 2 years or more qualify as 'ganancia ocasional' taxed at a flat 15% (Ley 2277 de 2022). Filing generally required if gross assets exceed 4,500 UVT (~COP 212M), gross income exceeds 1,400 UVT (~COP 65.9M), among triggers. Separately, residents holding assets abroad exceeding 2,000 UVT (~COP 104,748,000 for 2026) must file the annual 'Declaracion de activos en el exterior' (Formulario 160). The detail

Moving money in and out

Colombia operates an exchange-control regime (regimen cambiario) administered by Banco de la Republica with DIAN control. FX for certain regulated operations (foreign direct/portfolio investment, external debt) must be channeled obligatorily through the mercado cambiario via authorized Intermediarios del Mercado Cambiario (IMC - banks) or registered compensation accounts. Personal remittances for consumption fall in the free market and are not capped, but moving significant funds abroad and holding foreign investment can trigger channeling, registration (registro de inversiones), and declaration duties; residents must report foreign assets to DIAN. No fixed peso amount limit on funding a foreign broker per se, but reporting/channeling obligations apply. Local rails widely supported by offshore brokers: PSE (Pagos Seguros en Linea, debiting savings/checking accounts at any Colombian bank), local bank transfers (Bancolombia, Davivienda), debit/credit cards, and e-wallets Nequi and Daviplata. PSE and Nequi are fastest, typically crediting deposits in ~1-3 minutes at no broker commission; peso (COP) base-currency accounts are offered by some brokers (e.g. Exness accepts COP directly via PSE/Nequi without conversion) while others hold USD and apply an FX spread. Withdrawals often complete within an hour to a few business days.

What this means for choosing a broker

Tax is charged on what you made, not on where the broker is. What the broker's location does change is the paperwork you will have: a local entity reports in Colombia, a foreign one does not, and the statement you file comes from whichever entity signed you.
